Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
The commissioner of the division of capital planning and
operations may,
subject to the provisions of sections 40E to 40J
, inclusive,
of chapter 7 of the General Laws, except as otherwise provided in this act,
convey approximately 1,528 square feet
of land owned by the commonwealth and located on the southerly side of
Lowell street at the junction of Vernon street in the town of Wakefield, to the
owner of the property fronting said
land, being known as 383 - 413
Lowell street. Said land shall be more precisely described by the
commissioner based on the records in the Middlesex county registry of deeds or
registry district of the land court, or on a survey, as said commissioner may
determine.
SECTION 2.
The consideration paid by the purchaser for the parcel set
forth in section 1 shall be the full and fair market value of the property
determined by the commissioner of the division of capital planning and
operations based on an independent appraisal.
SECTION 3.
The purchaser of the parcel set forth in section 1 shall
assume all costs of appraisals, surveys, deed preparation and other expenses
related to the conveyance of this property as the commissioner of the division
of capital planning and operations may determine to be necessary, and shall be
responsible for all costs and liabilities of its condition, ownership, and
operation.
