Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
Notwithstanding the provisions of any general or special
law to the contrary, in order to implement its school building program, the
city of Medford may, in addition to the pre-qualification requirements pursuant
to section 44D of chapter 149 of the General Laws, establish and impose a
requirement that only contractors and subcontractors with a workers'
compensation experience modification factor, as promulgated by the workers'
compensation rating bureau, of 125 per cent or less shall be eligible to
submit a bid
or offer; provided, however, that any contractor or subcontractor with a
modification factor of up to 135 per cent shall be eligible to submit a bid or
offer,
if that modification factor was caused by a single loss. The school building
program of the city of Medford shall not be subject to the provisions of
section 44F of chapter 149 of the General Laws. For the purpose of this act,
the words "school building program" shall mean the design, construction and
equipping of five new schools within the city of Medford to accommodate
students in grades kindergarten through grade eight and the renovation or
demolition of any structures at any of the existing sites at said schools.
SECTION 2.
This act shall take effect upon its passage.
