Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
Notwithstanding any general or special law to the
contrary, the town of Plymouth acting by and through its town manager, may
enter into long-term ground leases for a term not to exceed 75 years of all
or any portion of certain parcels of town-owned land for the construction of
2 multi-level
parking facilities and retail shop space. Such leases shall be subject to
section 16 of chapter 30B of the General Laws except
that leases
with the Plymouth Development Corporation shall be exempt from said section 16
of said chapter 30B as provided in section 5 of chapter 182 of the acts of
2002. Such leases may provide that the lessee shall be responsible for the
design, development, construction and maintenance of improvements to the site
as outlined in the lease agreement.
SECTION 2.
The parcels are shown as Plot 19 Lot C-9 and C-4 and
Plot 17 Lot 100 on
the town of Plymouth assessor's map.
SECTION 3.
This act shall take effect upon its passage.
