Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
Notwithstanding any general or special law to the contrary, the secretary of
health and human services shall seek a waiver under Titles XIX and XXI of the
Social
Security Act to expand MassHealth comprehensive family planning services for
individuals and families whose incomes are at least up to 200 per cent of the
federal poverty level. The waiver request shall include those services
currently
covered as comprehensive family planning services, including comprehensive
medical and gynecological examinations, contraceptive counseling and methods,
sexually transmitted disease testing and treatment, screening for breast and
cervical cancer, related laboratory screenings, non-directive counseling and
referral for pregnancy and prenatal care, infertility and other health related
issues. The secretary shall notify the house and senate committees on ways and
means
and the joint committee on health care financing within 10 days after the
filing of the waiver request with the centers for Medicare and Medicaid
services and
shall notify those committees within 10 days after a decision on the waiver.
