AN ACT RELATIVE TO THE CREATION OF A TREASURER-COLLECTOR IN THE TOWN OF PLAINVILLE

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Notwithstanding any general or special law to the contrary, there shall be a treasurer-collector for the town of Plainville who shall be appointed by the town administrator.  The treasurer-collector shall have all the powers and perform all the duties now or hereafter conferred or imposed by law on town treasurers and tax collectors.  The treasurer-collector shall have all the powers and perform all the duties provided in this act or as assigned by the town administrator, including: (i) daily reporting to the town accountant; and (ii) supervising and directing the operations and employees of the office of the treasurer-collector pursuant to the General Laws or any special law applicable to the town, the town personnel by-laws and any applicable collective bargaining agreements.
     SECTION 2.  Notwithstanding section 1, the elected positions of treasurer and tax collector in the town of Plainville shall be abolished and the terms of the officers holding these offices shall be terminated; provided, however, that should the elected incumbent in 1 or both offices be the person holding office on the effective date of this act, the incumbent shall hold the appointed treasurer-collector position until the end of the elected term or, if sooner, the incumbent’s resignation or retirement.  After the incumbent vacates the office of the treasurer-collector, the town administrator shall appoint the treasurer-collector pursuant to section 1; provided, however, that nothing in this act shall prohibit the town administrator from appointing the incumbent who vacated office to the office of treasurer-collector.
     SECTION 3.  All records, property and equipment of the elected offices of treasurer and tax collector shall be transferred immediately to the appointed office of treasurer-collector.  All official bonds, obligations, contracts and other instruments entered into or executed by or on behalf of the town of Plainville prior to the effective date of this act and all taxes, assessments, fines, penalties and forfeitures incurred or imposed, due or owing to the town shall be enforced and collected, shall continue without abatement and shall remain unaffected by this act.
     SECTION 4.  The appointed treasurer-collector shall in all respects be the lawful successor of the offices abolished or consolidated pursuant to this act.  No person in the regular permanent full-time or part-time service or employment of the town shall forfeit a rate of compensation, grade, step or time of service on account of the creation of the appointed treasurer-collector position. Each person shall be retained in a capacity as similar as practical to the person’s former capacity. No collective bargaining agreement, contracts or liabilities in force on the effective date of this act shall be affected by the abolition of the offices of elected town treasurer and elected tax collector or the creation of the appointed treasurer-collector position pursuant to this act.
     SECTION 5.  This act shall take effect upon its passage.
