AN ACT AUTHORIZING THE TOWN OF MILLIS TO TRANSFER A CERTAIN PARCEL OF PARK LAND

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
     SECTION 1.  Notwithstanding any general or special law to the contrary, the board of selectmen of the town of Millis, acting in its capacity as the board of park commissioners, may transfer a certain parcel of land, currently held for park and recreational purposes and shown as “Convert Park to School Use Parcel A 6.40± acres” on a plan entitled "School Property – Plan of Land Proposed Article 97 Land Exchange Millis Massachusetts", page ex-2, dated January 2, 2017, and prepared by Nitsch Engineering, to the care, custody, management and control of the school committee of the town for school purposes.
     SECTION 2.  (a) In consideration for the transfer of the land pursuant to section 1, the board of selectmen of the town of Millis shall transfer the parcel of land shown as “Proposed Art 97 Parcel B 1.84± acres” on a plan entitled “Article 97 Property – Plan of Land Proposed Article 97 Land Exchange Millis Massachusetts”, page ex-3, dated January 2, 2017, prepared by Nitsch Engineering, and currently held for general municipal purposes to the care, custody, management and control of the conservation commission of the town of Millis for conservation and passive recreational purposes.
     (b)  In consideration for the transfer of the land pursuant to section 1, the school committee of the town of Millis shall transfer the parcels of land shown as “Proposed Art 97 Parcel C 1.09± acres”, “Proposed Art 97 Parcel D 3.21± acres” and “Proposed Art 97 Parcel E 3.74± acres on the plan referenced in subsection (a) and currently held for school purposes to the care, custody, management and control of the conservation commission of the town of Millis for conservation and passive recreational purposes.  The parcels transferred to the conservation commission of the town of Millis pursuant to this section shall be subject to Article XCVII of the Amendments to the Constitution of the Commonwealth.
     SECTION 3.  This act shall take effect upon its passage.
