AN ACT AUTHORIZING THE TOWN OF LENOX TO CONVEY A CONSERVATION RESTRICTION ON CERTAIN PARCELS OF LAND

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
     SECTION 1. (a) Notwithstanding any general or special law to the contrary, the town of Lenox, acting by and through its board of selectmen acting as the board of water commissioners, may convey to the town of Lenox, acting by and through its conservation commission, and to Berkshire Natural Resources Council, Inc. for no consideration a perpetual conservation restriction pursuant to sections 31 to 33, inclusive, of chapter 184 of the General Laws for the preservation of the water supply, fish and wildlife conservation, native habitat protection, forest management, passive recreation and other consistent purposes in certain parcels of land identified in section 2 upon such terms and conditions as the board of selectmen, acting as the board of water commissioners, shall determine to be appropriate.
     (b) The parcels of land to be subject to the conservation restriction pursuant to subsection (a) are identified as follows: (i) all of the land in the town of Lenox recorded in certain orders of taking and deeds in the Berkshire middle district registry of deeds in: (1) book 531, page 545, except the property described in book 588, page 8; (2) book 848, page 384; (3) book 558, page 245; (4) book 636, page 591; (5) book 644, page 338 and book 657, page 188; and (6) book 5880, page 148; and (ii) all of the land recorded in a deed in the Berkshire middle district registry of deeds in book 1201, page 913.
     SECTION 2. This act shall take effect upon its passage.
