AN ACT AUTHORIZING THE CITY OF FITCHBURG TO CHANGE THE USE OF A CERTAIN PARCEL OF LAND ACQUIRED FOR PARK PURPOSES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  (a) The city of Fitchburg may use an easement interest in approximately .4274 acres of land located at 0 Elm street for the construction of a new dedicated parking lot for the abutting Lowe park, for significant capital improvements to Lowe park and for economic development-related purposes, including parking and other improvements for the redevelopment of the former B.F. Brown middle school building. The easement interest is shown on a plan of land entitled “Easement Plan in Fitchburg, Massachusetts”, dated September 20, 2019 and prepared by Precision Land Surveying, Inc. The land is a portion of a certain parcel of land acquired by the city of Fitchburg for park purposes by a deed recorded in the Worcester northern district registry of deeds in book 206, page 210.

(b)  As mitigation for the change of use of the land pursuant to subsection (a), the city of Fitchburg shall dedicate approximately 2.28 acres of land located at 0 Battles avenue and 0 Adin street for conservation purposes. The land at 0 Battles avenue is described in deeds recorded in the Worcester northern district registry of deeds in book 509, page 99 and book 625, page 571.  The land at 0 Adin street is described in a deed recorded in the Worcester northern district registry of deeds in book 9160, page 264.

SECTION 2.  This act shall take effect upon its passage.
