SECTION 1. Notwithstanding the provisions of section 17 of chapter 138 of the General Laws, the licensing authority of the Town of Harvard may grant up to three licenses for the sale of wine and malt alcoholic beverages not to be drunk on the premises under section 15 of said chapter 138, provided that one such license may only be granted to the owner or operator of the premises known as the Harvard General Store located at 1 Still River Road in the town of Harvard. Once issued, a license granted under this section shall not be transferred to any other location and no such license shall be re-issued to the same location within 6 months from the date the prior license terminated unless the applicant files a letter in writing from the department of revenue with the local licensing authority indicating the prior licensee's good standing with said department. If a license granted under this section is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority of the Town of Harvard. Notwithstanding section 17 of chapter 138 of the General Laws or any other general or special law to the contrary, the licensing authority may then grant the license to a new applicant at the same location and under the same conditions as specified in the preceding paragraph.
SECTION 2. This act shall take effect upon its passage.
