An Act Relative to GPS Monitoring During Pretrial Probation..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 47 of chapter 265 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by striking in line 1 the words “for any offense” and inserting in place thereof the following words:- or any person who is placed on pretrial probation charged with any offense
SECTION 2. Section 47 of chapter 265 of the General Laws, as so appearing, is hereby further amended by striking, in line 24, the words “an offender” and inserting in place thereof the words:- a probationer
SECTION 3. Section 47 of chapter 265 of the General Laws, as so appearing, is hereby amended by adding the following sentences at the end thereof:-
For the purposes of this section, the term “probation” shall mean all forms of pretrial probation, including a temporary placement pending trial or a pretrial disposition of the case, and all forms of probation post conviction.
For the purposes of this section, the term “probationer” shall mean any individual placed on probation, whether found guilty, given a continuance without a finding after admitting to sufficient facts, or prior to trial.
