SECTION 1. Notwithstanding any limitations imposed by section 11, 11 A , and 17 of Chapter 138 of the General Laws or any other special law or general law to the contrary, the Board of Selectmen of the Town of Tisbury is hereby authorized to place upon the office ballot at the next Annual Town Election the following question:
"Shall the Board of Selectmen be authorized to petition the State Legislature to allow the Town of Tisbury to issue licenses (without quota and for a season or annual term as the Selectman may determine) for the sale of beer and wine to patrons of restaurants (including restaurants within inns and hotels) with a seating capacity of not less than 30 persons, to be consumed with meals only, and only to patrons who are seated at a dining table?"
If a majority of the votes cast in said town in answer to the question in the affirmative, the Town shall be taken to have authorized the sale in said Town of beer and wine to be consumed on the premises of said restaurants. Nothing contained herein shall authorize the issuance of licenses for the sale of beer and wine to be consumed not on the premises, i.e., in a package or convenience store, and nothing contained herein shall authorize the separate sale alcoholic beverages without meals. The Board of Selectmen may from time to time issue regulation for the granting of said licenses and to define terms appropriate to carrying out this act.
SECTION 2. This act shall take effect upon its passage.
