An Act concerning the authority of the department of public health to operate the public health hospitals..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 62J of chapter 111 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by striking out, in line 6, the words “board of trustees” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 2. Section 62K of said chapter 111, as so appearing, is hereby amended by striking out, in lines 6-8, the words “or for the use or benefit of state minor wards assigned to the care of the trustees under sections sixty-two P to sixty-two S, inclusive,”.
SECTION 3. Section 62L of said chapter 111 is hereby repealed.
SECTION 4. Section 62 M of said chapter 111, as appearing in the 2006 Official Edition, is hereby amended by striking out, in line 1, the word “trustees” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 5. Section 62M of chapter 111, as so appearing, is hereby amended by striking out, in line 6, the word “trustees” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 6. Said section 62M of said chapter 111, as so appearing, is hereby further amended by striking out, in line 16, the word “trustees” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 7. Said section 62M of said chapter 111, as so appearing, is hereby further amended by striking out, in line 18, the words “trustees, with the approval of the department” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 8. Said section 62M of said chapter 111, as so appearing, is hereby amended by striking out, in line 25, the word “trustees with the approval of the department” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 9. Said section 62M of said chapter 111, as so appearing, is hereby amended by striking out, in line 27, the words “trustees, with the approval of the department” and inserting in place thereof the following words:- commissioner or his designee.
SECTION 10. Said chapter 111 is hereby further amended by striking out section 62N and inserting in place thereof the following section:-
Section 62N. The trustees shall submit to the commissioner on an annual basis a report of the activities undertaken pursuant to section 62K.
SECTION 11. Section 62O of said chapter 111 is hereby repealed.
SECTION 12. Section 62P of said chapter 111 is hereby repealed.
SECTION 13. Section 62Q of said chapter 111 is hereby repealed.
SECTION 14. Section 62R of said chapter 111 is hereby repealed.
SECTION 15. Section 1 of chapter 122 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by striking out, in line 8, the words “,with the approval of the superintendent and trustees,”.
SECTION 16. Section 4 of said chapter 122 is hereby repealed.
SECTION 17. Section 7 of said chapter 122, as appearing in the 2006 Official Edition, is hereby amended by striking out, in lines 8-12, the words “; provided that so much of any monies so paid to the state treasurer as may be necessary to reimburse the trustees for any sum due for the support of the person by whom or for whose benefit such money was originally deposited shall be credited to said trustees for that purpose”.
SECTION 18. Section 8 of said chapter 122, as so appearing, is hereby amended by striking out, in lines 4-6, the words “and a representative of the trustees designated by them acting as a special board for said purpose”.
SECTION 19. Said section 8 of said chapter 122, as so appearing, is hereby amended by striking out, in line 7, the word “board” and inserting in place thereof the following word:- superintendent.
SECTION 20. Said section 8 of said chapter 122, as so appearing, is hereby further amended by striking out, in line 12, the word “board” and inserting in place thereof the following words:- the superintendent.
SECTION 21. Said section 8 of said chapter 122, as so appearing, is hereby further amended by striking out, in lines 16 and 17, the words “both members of the board” and inserting in place thereof the following word:- superintendent.
SECTION 22. Section 9 of said chapter 122, as so appearing, is hereby amended by striking out, in line 5, the word “trustees” and inserting in place thereof the following word:- superintendent.
SECTION 23. Said section 9 of said chapter 122, as so appearing, is hereby further amended by striking out, in line 6, the word “their” and inserting in place thereof the following word: - his.
SECTION 24. Said section 9 of said chapter 122, as so appearing, is hereby further amended by striking out, in line 6, the word “them” and inserting in place thereof the following words: - the commonwealth.
SECTION 25. Said section 9 of said chapter 122, as so appearing, is hereby further amended by striking out, in lines 6-9, the words “except so much as in excess of the amount due the commonwealth for the support of such patients, and such bank or trust company shall thereupon pay to the trustees the amount so requested.”
SECTION 26. Section 10 of said chapter 122 is hereby repealed.
SECTION 27. Section 14 of said chapter 122, as appearing in the 2006 Official Edition, is hereby amended by striking out, in line 7, the words “and the trustees”.
SECTION 28. Section 15 of said chapter 122, as so appearing, is hereby amended by striking out, in line 1, the words “, with the consent of the trustees,”.
SECTION 29. Said section 15 of said chapter 122, as so appearing, is hereby further amended by striking out, in line 4, the words “and trustees”.
