An Act relative to motorcycle permit requirements..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 8B of Chapter 90 is hereby amended by adding at the end thereof the following new text:-
Notwithstanding the preceding paragraphs, the registrar shall not issue a learner’s permit restricted to the operation of a motorcycle (Class M) or endorsement to an applicant who has not reached the age of 18 without first verifying that the applicant has:
successfully completed a course of study at a rider training school as approved by the registrar;
held a valid Class D license to operate motor vehicles issued pursuant to section 8, or a similar law of another state, for a period of not less than twelve months immediately preceding the date of application;
maintained a driving record free of any surchargeable incidents for a period of not less than twelve months immediately preceding the date of application, as described in section 113B of chapter 175, and has not had such permit suspended under section 24P, or a similar law of another state, and has not been convicted of violating any alcohol-related or drug-related law of the commonwealth, or a similar alcohol-related or drug-related law of another state. For the purposes of this subsection, an alternate disposition of a violation including, but not limited to, having such violation continued without a finding or placed on file shall be deemed to be a conviction.
