An Act relative to the alcohol beverages control commission..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 15 of Chapter 138, as appearing in the 2006 Official Edition, is hereby amended by deleting in the second sentence beginning on line 18 and inserting in place thereof the following:- “No person, firm, corporation, association, or other combination of persons, directly or indirectly, or through any agent, employee, stockholder, officer or other person or any subsidiary whatsoever, shall be granted, in the aggregate, more than twenty such licenses in the commonwealth, or participate in decisions regarding the purchasing of alcoholic beverages or the purchasing of insurance or accounting or bookkeeping services, or receive any percentage or fee derived from gross revenues in exchange for management assistance, or participate in any other action designed to effect common results of more than 20 licensees under this section, or be granted more than one such license in a town or two in a city. All applicants for new licenses or transfer of license when the granting of such new license or transfer shall result in the applicant owning more than three licenses shall pay a fee of up to $5,000 to the commission upon approval of the application prior to the granting of said license for each such new license or transferred license.”
SECTION 2. Chapter 138 of the General Laws, as appearing in the 2006 Official Edition, is hereby amended by adding the following new section:-
Section 15B. There is hereby created on the books of the commonwealth an account for the purpose of collecting the fees specified in Section 15 of Chapter 138. Expenditures from said account shall be subject to appropriation.
