SECTION 1. The city of Attleboro may utilize “design build” phased construction approach for projects being undertaken as part of the economic stimulus legislation passed by the federal government in 2009 which requires that projects must be ready for construction and commence with 180 days of the approval of such stimulus package. Notwithstanding section 42B of chapter 7, section 39M of chapter 30, chapter 30B and Chapter 149 of the General Laws projects that qualify for said exemption must have a conceptual design completed by an approved design agent that clearly shows the scope of the whole project, as well as the detailed design and construction documents completed for the portion that will go out to bed as part of the “phased construction”. The approved design agent shall also certify in written form that the “phased construction” is 100% compatible with the overall “conceptual design”, and that all work completed as part of the “phased construction” will be useable as is, and no more than 5% of overall work performed shall be planned to be dismantled, destroyed or otherwise rendered “not usable”.
SECTION 2. This act shall take effect upon passage.
