An Act relative to manufactured homes..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Chapter 6 of the General Laws is hereby amended by striking out section 108, as appearing in the 2006 Official Edition, and inserting in place thereof the following section:-

Section 108.  There shall be a manufactured home commission hereafter referred to as the commission consisting of 5 members.  3 members shall be appointed by the governor.  At least 1 of whom shall be a resident of the manufactured  home community, 1 of whom shall be an owner of a manufactured home community and 1 of whom shall be a citizen at large.  The 2 remaining positions shall be appointed by the attorney general or his designee and the undersecretary of housing or his designee.

The commission may grant and may suspend or revoke licenses for manufactured housing communities, which licenses, unless previously suspended or revoked, shall expire on December 31st in the year of issue, but may be renewal annually upon application without notice of hearing.

The commission shall identify issues, hear complaints and make recommendations for remedies including, but not limited to suspension or revocation of license or legal action initiated by the attorney general.

Upon suspension or revocation, the owner shall escrow rents until license is reinstated.

SECTION 2.  Section 32BB of chapter 140 of the General Laws, as so appearing, is hereby amended by striking out in line 5 the words:- “motels or manufactured housing communities” and inserting in place thereof the following words: or motels

SECTION 3. Section 32C of said chapter 140, as so appearing, is hereby amended by striking out in line 2 the words:- “manufactured housing communities”

SECTION 4. Said section 32C of said chapter 140, as so appearing, is hereby further amended by striking out in line 4 the words:- “manufactured housing community”

SECTION 5. The first paragraph of section 32F of said chapter 140, as appearing is hereby amended by striking out the second and third sentences and inserting in place thereof the following 2 sentences:-

No lot or tract of land may be used for a manufactured housing community unless the owner or occupant thereof is the holder of a license granted under section 108 of chapter 6.  The manufactured home commission shall forthwith upon granting an original or renewal license under said section 108 of chapter6 for a manufactured housing community, send a copy of such license to the city or town clerk.
