The commissioner of the department of public health, in consultation with the board of registration in pharmacy and the secretary of energy and environmental affairs, shall establish guidelines governing the proper disposal of unused or expired prescription drugs. In connection with federal guidelines on the safe disposal of unused or outdated prescription drugs, the commissioner shall set criteria for collection points and take back programs. The commissioner may include regulations requiring those whom manufacturer, sell or resell prescription drugs to also accept unused prescription drugs, regardless of the purchase point, and to safely dispose of these drugs under the standards to be created by the department of public health.
