An Act relative to changing the name state college to state university..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 18B of chapter 6 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the words “state colleges”, in lines 4 and 35, and inserting in place thereof the words “state universities”. 

SECTION 2. Section 35EE of chapter 10 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the words “state colleges”, in line 22, and inserting in place thereof the words “state universities”.

SECTION 3.  Section 18A of chapter 15 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the words “state colleges”, in lines 7-8, and inserting in place thereof the words “state universities”.

SECTION 4.  The fourth paragraph of section 1 of chapter 15A of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the first sentence the following sentence:- The state’s system of public higher education shall consist of the following segments: (1) the university segment, which shall consist of the University of Massachusetts at Amherst, Boston, Dartmouth, Lowell and Worcester; (2) the state university segment, which shall consist of Bridgewater State University, Fitchburg State University, Framingham State University, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, the Massachusetts College of Liberal Arts, Salem State University, Westfield State University, and Worcester State University; and (3) the community college segment, which shall consist of Berkshire Community College, Bristol Community College, Bunker Hill Community College, Cape Cod Community College, Greenfield Community College, Holyoke Community College, Massachusetts Bay Community College, Massasoit Community College, Middlesex Community College, Mount Wachusett Community College, Northern Essex Community College, North Shore Community College, Quinsigamond Community College, Roxbury Community College, and Springfield Technical Community College. 

SECTION 4A.  Said section 1 of said chapter 15A is hereby further amended by striking out the words “state college”, in line 32, and inserting in place thereof the words “state university”. 

SECTION 5.  Section 4 of said chapter 15A is hereby amended by striking out the words “state university”, in line 20, and inserting in place thereof the words “university of Massachusetts”. 

SECTION 5A.   Said section 4 of said chapter 15A is hereby further amended by striking out the words “a state college chosen by vote of the chairs of the boards of trustees of each of the state colleges”, in lines 21-22, and inserting in place thereof the words:- a state university, chosen by vote of the chairs of the boards of trustees of each of the state universities. 

SECTION 5B.  The seventh sentence of said section 4 of said chapter 15A is hereby amended by striking out the words “state colleges”, in line 27, inserting in place thereof the following sentence:- state universities.

SECTION 6.  The second sentence of section 4A of said chapter 15A is hereby amended by striking out the words “1 of whom shall be a chancellor of a state university or college, 1 of whom shall be a president of a state college or his designee”, in lines 27-28, and inserting in place thereof the words:- 1 of whom shall be a chancellor of a campus of the university of Massachusetts or his designee, 1 of whom shall be the president of a state university or his designee. 

SECTION 7.  Section 5 of said chapter 15A, is hereby amended by striking out the words “Bridgewater State College, Fitchburg State College, Framingham State College, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, Massachusetts College of Liberal Arts, Salem State College, Westfield State College, Worcester State College”, in lines 5-8, and inserting in place thereof the following:- Bridgewater State University, Fitchburg State University, Framingham State University, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, the Massachusetts College of Liberal Arts, Salem State University, Westfield State University, Worcester State University. 

SECTION 8.  The first paragraph of section 7 of said chapter 15A is hereby amended by striking out the words “state college”, in line 3, and inserting in place thereof the words “state university”.

SECTION 8A.  The second paragraph of said section 7 of said chapter 15A is hereby amended by striking out the second sentence, and inserting in place thereof the following:- The board of trustees of each state university and community college shall develop and submit to the secretary and the council a mission statement for each such institution.

SECTION 8B.  The second paragraph of said section 7 of said chapter 15A is hereby further amended by inserting after the word “state”, in line 23, the word “university”.

SECTION 9.  Paragraph (b) of section 7A of said chapter 15A is hereby amended by inserting after the word “state”, in lines 12-13, the word “universities”.

SECTION 9A.  Paragraph (c) of said section 7A of said chapter 15A is hereby amended by inserting after the word “state”, in line 27, the word “university”.

SECTION 10. Section 9 of said chapter 15A is hereby amended by striking out the words “state colleges”, in lines 55, 70, 94 and 136, and inserting in place thereof the words “state universities”. 

SECTION 10A. Said section 9 of said chapter 15A is hereby further amended by striking out the words “state college”, in line 105, and inserting in place thereof the words “state university”. 

SECTION 10B. Said section 9 of said chapter 15A is hereby further amended by striking out the words “public university, state college or community college”, in lines 169-170, and inserting in place thereof the words “public institution of higher education”.  

SECTION 11.  Section 14 of said chapter 15A is hereby amended by striking out the words “state university”, in line 1, and inserting in place thereof the words “university of Massachusetts”. 

SECTION 12.  Section 15 of said chapter 15A is hereby amended by striking out the words “state colleges”, in line 24, and inserting in place thereof the words “state universities”. 

SECTION 12A. Said section 15 of said chapter 15A is hereby further amended by striking out the words “state college”, in line 26, and inserting in place thereof the words “state university”.

SECTION 13. Section 15B of said chapter 15A is hereby amended by inserting after the word “state”, in line 23, the word “university”. 

SECTION 14.  Section 15E of said chapter 15A is hereby amended by striking out the words “state university and public colleges”, in line 2, and inserting in place thereof the words “public institutions of higher education”.

SECTION 14A.  Said section 15E of said chapter 15A is hereby further amended by striking out  the words “state college’s”, in line 19, and inserting in place thereof the words “state university’s”.

SECTION 14B.  Said section 15E of said chapter 15A is hereby further amended by striking out  the words “state college”, in line 36, and inserting in place thereof the words “state university”.

SECTION 15. Section 19 of said chapter 15A is hereby amended by striking out the words “public college or university”, in lines 40-41, and inserting in place thereof the words “public institution of higher education”.

SECTION 15A.  Said section 19 of said chapter 15A is hereby further amended by striking out  the words “state college”, in line 45, and inserting in place thereof the words “state university”. 

SECTION 15B. Said section 19 of said chapter 15A is hereby further amended by striking out the words “public college or university”, in lines 65, and 85-86, and inserting in place thereof the words “public institution of higher education”.

SECTION 16. Section 19D of said chapter 15A is hereby amended by striking out the words “public college or university”, in lines 13-14, and inserting in place thereof the words “public institution of higher education”.

SECTION 17. Section 22 of said chapter 15A is hereby amended by striking out the words “state college”, in lines 1-2, and inserting in place thereof the words “state university”.

SECTION 17A. Said section 22 of said chapter 15A is hereby further amended by striking out the words “state college”, in line 84, and inserting in place thereof the words “state university”.

SECTION 18.  Section 37 of said chapter 15A is hereby amended by striking out the words “public college or university”, in line 13, and inserting in place thereof the words “public institution of higher education”.

SECTION 19. Section 6 of chapter 69 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the words “state college”, in line 3, and inserting in place thereof the words “state university”.

SECTION 20.  Section 8 of said chapter 69 is hereby amended by striking out the words “state college”, in line 5, and inserting in place thereof the words “state university”.

SECTION 21.  Section 1 of chapter 73 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following paragraph:- As used in this chapter, the words “state college” or “state colleges” shall be deemed to mean: Bridgewater State University, Fitchburg State University, Framingham State University, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, the Massachusetts College of Liberal Arts, Salem State University, Westfield State University, and Worcester State University. 

SECTION 22.  Section 1 of chapter 75 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the word “state”, in line 1, and inserting in place thereof the word “state’s”. 

SECTION 23.  Section 1 of chapter 90C of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out the words “state and community colleges”, in lines 76 and 90, and inserting in place thereof the words “state universities and community colleges”.

SECTION 23A.  Section 2 of said chapter 90C is hereby amended by striking out the words “state or community colleges”, in lines 11 and 46, and inserting in place thereof the words “state universities or community colleges”.

SECTION 23B.  Said section 2 of said chapter 90C is hereby further amended by striking out the words “state or community college”, in lines 13-14, 30-31, 32 and 41, and inserting in place thereof the words “state university or community college”.  

SECTION 24.  Section 1 of chapter 703 of the acts of 1963, as most recently amended by sections 4 and 5 of chapter 258 of the acts of 2008, is hereby amended by striking out paragraph (h) and inserting in place thereof the following:- (h) “State college”, any of the following public institutions of higher education: Bridgewater State University, Fitchburg State University, Framingham State University, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, the Massachusetts College of Liberal Arts, Salem State University, Westfield State University, and Worcester State University.

SECTION 25.  With the exception of section 24, nothing in this act shall be construed to affect the Massachusetts State College Building Authority, established pursuant to chapter 703 of the acts of 1963, as amended, or the obligations, agreements, authorities or responsibilities thereof. 

SECTION 26.  Nothing in this act shall be deemed to alter any bargaining unit that exists at Bridgewater State University, formerly known as Bridgewater State College, Fitchburg State University, formerly known as Fitchburg State College, Framingham State University, formerly known as Framingham State College, the Massachusetts College of Art and Design, the Massachusetts Maritime Academy, the Massachusetts College of Liberal Arts, Salem State University, formerly known as Salem State College, Westfield State University, formerly known as Westfield State College, and Worcester State University, formerly known as Worcester State College, on the effective date of this act.  No action taken pursuant to this act shall be deemed to be justification for altering any bargaining unit that exists at said institutions on the date immediately preceding the effective date of this act. 

SECTION 27.  Any reference, by connotation or otherwise, to the state colleges generally or to any one or more of them individually in any general or special law, or in any rule, regulation, order, by-law, deed, indenture or other document or instrument shall be and be deemed to be a reference, respectively, to the state universities enumerated in clause (2) of the fourth paragraph of section 1 of chapter 15A of the General Laws, inserted by this act, generally, or to the corresponding state university, whether one or more, individually.
