An Act authorizing the division of capital asset management and maintenance to transfer care and control of certain land in Boston..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  The division of capital asset management and maintenance, in consultation with the department of conservation and recreation, may transfer the care, custody, management and control of certain parcels of land in the city of Boston, currently under the care, custody and control of the department of conservation and recreation, to the Massachusetts bay transportation authority to be used for mass transit purposes, which shall be limited to improvements to the science park station.

SECTION 2.  The parcels to be transferred consist of one thousand four hundred thirty-three (1,433 SF +/-) square feet, more or less and shown as Parcels PE-1 and PE-2 on a plan entitled “Land Acquisition Plan, Boston, Massachusetts, dated 03/31/2010, Scale: 1”=20’, prepared by AECOM, 66 Long Wharf, Boston, Massachusetts 02110,” more particularly described as follows:

Parcel PE-1

Beginning at a point located within the existing traffic island on the northerly side of the existing MBTA Science Park Station, said point being designated as point “P1” having a grid coordinate of North 2959018.129, East 772975.717 of the Massachusetts State Plane Coordinate System (Mainland Zone) (NAD-83-96);

thence S 55º50’57” E, a distance of nine and 09/100 (9.09’) feet to point designated as “P2”;

thence S 34º09’03” W, a distance of three and 91/100 (3.91’) feet to point designated as “P3”;

thence S 55º51’00” E, a distance of ten and 96/100 (10.96’) feet to point designated as “P4”;

thence S 34º09’01” W, a distance of seven and 00/100 (7.00’) feet to point designated as “P5”;

thence S 55º50’57” E, a distance of eight and 99/100 (8.99’) feet to point designated as “P6”;

thence S 34º09’03” W, a distance of eleven and 67/100 (11.67’) feet to point designated as “P7”;

thence N 55º51’00” W, a distance of nine and 75/100 (9.75’) feet to point designated as “P8”;

thence S 34º08’44” W, a distance of eight and 83/100 (8.83’) feet to point designated as “P9”;

thence N 55º51’03” W, a distance of seventeen and 75/100 (17.75’) feet to point designated as “P10”;

thence N 34º09’03” E, a distance of twenty-five and 42/100 (25.42’) feet to point designated as “P11”;

thence N 55º50’57” W, a distance of one and 54/100 (1.54’) feet to point designated as “P12”;

thence N 34º09’03” E, a distance of six and 00/100 (6.00’) feet to the point of beginning.

The above described parcel contains six hundred forty-six (646 SF +/-) square feet, more or less and is shown as Parcel PE-1 in said plan.

Parcel PE-2

Beginning at a point located within the existing traffic island adjacent to the southerly side of the existing MBTA Science Park Station, said point being designated as point “P13” having a grid coordinate of North 2958964.965, East 772913.826 of the Massachusetts State Plane Coordinate System (Mainland Zone) (NAD-83-96);

thence S 55º33’43” E, a distance of fifty and 95/100 (50.95’) feet to point designated as “P14”;

thence S 34º09’00” W, a distance of five and 66/100 (5.66’) feet to point designated as “P15”;

thence S 63º17’17” W, a distance of twenty-eight and 77/100 (28.77’) feet to point designated as “P16”;

thence N 55º51’00” W, a distance of eight and 52/100 (8.52’) feet to point designated as “P17”;

thence N 34º09’00” E, a distance of twenty-one and 54/100 (21.54’) feet to point designated as “P18”;

thence N 55º51’02” W, a distance of twenty-eight and 42/100 (28.42’) feet to point designated as “P19”;

thence N 34º09’00” E, a distance of nine and 51/100 (9.51’) feet to the point of beginning.

The above described parcel contains seven hundred eighty-seven (787 SF +/-) square feet, more or less and is shown as Parcel PE-2 in said plan.

SECTION 3.  If either parcel described in section 2 ceases to be used for purposes described in section 1, the parcel(s) shall revert to the care, custody, management and control of the department of conservation and recreation.
