SECTION 1. Notwithstanding the provisions of section 6D of chapter 40 of the General Laws as to the time and manner of voting on the question, the state secretary shall cause to be placed on the official ballot to be used in the city of Gardner at the biennial state election to be held in the year 2010 the following question:
Shall the city of Gardner vote to accept the provisions of section six C of chapter forty of the General Laws, which authorize cities and towns to appropriate money for the removal of snow and ice from private ways therein open to public use?

SECTION 2. If a majority of the votes in answer to said question is in the affirmative, then said section shall thereupon take full effect in such city or town, but not otherwise.
SECTION 3. This act shall take effect upon passage.
