An Act authorizing the division of capital asset management and maintenance to lease certain Nantasket Beach reservation buildings and park land in the town of Hull for development purposes..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The commissioner of capital asset management and maintenance, in consultation with the commissioner of conservation and recreation, may, notwithstanding sections 40E to 40I, inclusive, of chapter 7 of the General Laws, lease a certain parcel of land and any improvements thereon for not less than 99 years, currently under the control of and used by the department of conservation and recreation for recreation and conservation purposes, to the town of Hull, for the purposes of economic development, subject to the requirements of sections 2 and 3 and to such additional terms and conditions consistent with this act as the commissioner of capital asset management and maintenance may prescribe in consultation with the commissioner of conservation and recreation. The parcel, shown on Assessor’s map 37, Lots 001-A and 008, being a portion of the Nantasket Beach Reservation is bounded by Nantasket avenue on the east, Hull Shore drive on the north, George Washington boulevard on the west and Wharf avenue on the south. The exact boundaries of the parcel shall be established prior to such lease by a survey approved by the commissioner of capital asset management and maintenance.
Modification to the plan described above may be made prior to the conveyance in order to carry out the purposes of this act.
SECTION 2. The lease authorized in section 1 shall be granted only if the leasee agrees to assume the cost of any surveys and other expenses deemed necessary by the commissioner of capital asset management and maintenance for the transactions contemplated by this act.
SECTION 3. The grantee shall compensate the commonwealth for the property described in section 1 by providing necessary storage space for DCR maintenance equipment.
