An Act Authorizing the Town of Northborough to Convey Certain Playground Land ..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding the provisions of any general or special law to the contrary and pursuant to the provisions of Article 97 of the Amendments to the Constitution of the Commonwealth of Massachusetts, the Town of Northborough is hereby authorized to transfer and convey two certain parcels of land, being portions of land owned by the Town of Northborough held for playground purposes, and described in a deed dated January 5, 1989, recorded with the Worcester South District Registry of Deeds in Book 12219, Page 366, said portions shown on a survey plan entitled “Plan of Land in Northborough, Massachusetts, Owned by the Town of Northborough, Scale 1” = 40’, Date: February 17, 2009, Prepared by R.W.Hart Associates, Inc., Northborough, Massachusetts, Registered Land Surveyors & Engineers “ (the “Plan”), said conveyances to be as follows: (1) a fee interest in a parcel described as “Parcel C-2,” consisting of 3,678 square feet,  more or less, as shown on the Plan, to Robert A. DiGregorio and Joyce DiGregorio, or their successors or assigns, being the site of an existing pool and appurtenant buildings, and (2) a fee interest in a parcel described as “Parcel C-3,” consisting of 3,680 feet, more or less, as shown on the Plan, to Andrew D.W. McKie and Susan E. McKie, or their successors or assigns, being the site of an existing driveway, with the remainder of the property shown on the Plan (3.1274 acres, more or less) to continue to be held for playground purposes under the jurisdiction of the Northborough Parks and Recreation Commission.

SECTION 2. This act shall take effect upon passage.
