An Act FURTHER REGULATING INVESTIGATION OF THE SALE OF ALCOHOLIC BEVERAGES.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of any general or special law or rule or regulation to the contrary, the alcoholic beverages control commission shall retain not more than $150,000.00 of the fines in lieu of suspension collected pursuant to General Laws chapter 138, § 23. Such amount retained from the fines in lieu of suspension shall be deposited into a retained revenue account hereby established for the alcoholic beverages control commission, and shall be expended without further appropriation for payment of overtime work conducted by the Investigation and Enforcement Division in its enhanced enforcement programs, known as Safe Campus, Safe Holidays, Safe Prom, and Safe Summer, that shall be operated for the purpose of enforcing underage drinking laws pursuant to Massachusetts General Laws chapter 138, s§34, 34A, 34B and 34C as well as enforcing the law against the sale or delivery of alcoholic beverages to intoxicated persons pursuant to Massachusetts General Laws Chapter 138 §69, but such funds shall not be considered a source of revenue to meet the operating needs of the commission.
The commission shall use amounts in said retained revenue account for the aforesaid purposes and for no other, without the need for further appropriation.
SECTION 2. This act shall take effect upon its approval.
