To the Honorable Senate and House of Representatives:
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating the Results of the Special Town Election Held in the Town of Wenham on December 17, 2009.”
Senator Tarr , Representative Hill and the Wenham Board of Selectmen have requested that I file this special legislation on behalf of the Town. The purpose of the legislation is to validate votes and actions taken at a Special Town Election held on December 17, 2009 and all actions taken pursuant thereto. The Town erred by failing to include a warrant reference to the Special Election, which was held for the purpose of authorizing an appropriation outside of proposition 2-1/2. The funds are necessary to replace a heating system in a school building in the Wenham-Hamilton regional school district.
I urge your early and favorable consideration of this bill.
Respectfully submitted ,
DEVAL L. PATRICK,
The Commonwealth of Massachusetts
