SECTION 1. Section 39 of chapter 148 of the General Laws, as appearing in the 2000 Official Edition, is hereby amended by inserting after the third paragraph the following paragraph:-
Whoever advertises the sale, use or possession of fireworks shall be punished by a fine of not less than $100 nor more than $1,000 or by imprisonment in a house of correction for not more than 1 year, or by both such fine and imprisonment. For the purposes of this section, “advertises” shall mean: (1) to cause a public announcement to be made, by means of radio, television, newspaper, flyer, catalog, billboard, mobile or stationary sign, or by any other means, in which a person’s name or business name style appears, and which offers to sell or transfer fireworks; or (2) to cause a person’s name, or business name style to be included in any classified advertisement or directory for the purpose of the sale or transfer of fireworks
