An Act relative to identity theft jurisdiction.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 37B of chapter 266 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the words “may be arrested without a warrant by such police officer” the following sentence: Whoever is charged with violating this section may be prosecuted and punished in the same jurisdiction in which the theft of the credit card information occurred, or where the credit card information was used with the intent to defraud.
SECTION 2. Section 37C of said chapter 266, as so appearing, is hereby amended by inserting after the words “may be arrested without a warrant by such police officer” the following sentence: Whoever is charged with violating this section may be prosecuted and punished in the same jurisdiction in which the theft of the credit card information occurred, or where the credit card information was used with the intent to defraud.
SECTION 3. Section 37E of said chapter 266, as so appearing, is hereby amended by inserting after the words “the offense of identity fraud as defined in this section” the following sentence: Whoever is charged with violating this section may be prosecuted and punished in the same jurisdiction in which the theft of the personal identifying information occurred, or where the personal identifying information was used with the intent to defraud.
