An Act relative to news carriers..

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 6 of chapter 151A of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out subsection (o) and inserting in place thereof the following section:-

(o) Service performed by an individual in the delivery or distribution of newspapers or shopping news; provided, however, that this shall not include delivery or distribution to any point for subsequent delivery or distribution.

SECTION 2. The first paragraph of subsection (4) of section 1 of chapter 152 of the General Laws, as so appearing, is hereby amended by striking out, in lines 59 to 62, inclusive, the words “and (g) a person whose employment is not in the usual course of the trade, business, profession or occupation of his employer, but not excepting a person conclusively presumed to be an employee under section twenty-six” and inserting in place thereof the following words:- (g) a person whose employment is not in the usual course of the trade, business, profession or occupation of his employer, but not excepting a person conclusively presumed to be an employee under section 26, and (h) a person delivering or distributing newspapers or shopping news; provided, however, that this shall not include a person delivering or distributing to any point for subsequent delivery or distribution.
