Section 1: The Commissioner of Capital Asset Management and Maintenance acting for and on behalf of the Commonwealth, is hereby authorized, subject to the provisions of sections forty E through forty J of chapter seven of the Massachusetts General Laws, to acquire by eminent domain, purchase or otherwise certain portions of parcels of land owned by the Town of Concord and described in section 2. Said portions of parcels are to be diverted from a conservation use to a highway use not withstanding any conservation restriction. As to parcel 9-TE-6 the diversion of use will be temporary.
Section 2: Said parcels are shown on a plan entitled The Commonwealth of Massachusetts Plan of Land in the Town of Concord Middlesex County Article 97 Property. This plan shall be kept on file with the chief engineer of the Massachusetts Department of Transportation - Highway Division. The descriptions of the parcels referred to in section one are as follows:
Parcel 9-8. A parcel of land now or formerly owned by Town of Concord (Conservation), adjoining the northerly location line of the October 10, 1933 State Highway Layout (Layout No. 3049) of the Concord Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 9-8 for the purpose of highway widening and bounded as follows: beginning at a point offset to the state baseline at station 17+35.08, 50.00 feet right on the aforesaid October 10, 1933 State Highway Layout Line; thence continuing northeasterly along the aforesaid October 10, 1933 State Highway Layout to a point by a bearing N 64°57’24” E and 123.71 feet distant; thence northwesterly by land now or formerly of the Commonwealth of Massachusetts to a point by a bearing N 45°40’50” W and 9.65 feet distant on the Proposed State Highway Layout Line (Layout No. 7964) at a point bearing N 24°52’46” W and 59.02 feet distant right from station 16+14.80 of the state baseline of said Concord Turnpike (Route 2); thence continuing southwesterly along aforesaid Proposed Layout Line by a bearing S 60°49’47” W and 120.62 feet distant to the point of beginning; containing about 558 square feet.
Parcel 9-D-1. An easement is hereby taken in the parcel of land now or formerly owned by Town of Concord (Conservation), adjoining the northerly location line of the October 10, 1933 State Highway Layout (Layout No. 3049) of the Concord Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 9-D-1 for the purpose of constructing a wildlife crossing outlet, headwall, drainage pipe and outlet, treatment swale, slope work and performing other incidental work in connection therewith and consisting of the right to enter upon said land at any time to construct thereon slopes of excavation and embankment and to maintain the structures and slopes and bounded as follows: beginning at a point offset to the state baseline at station 19+75.00 and 50.00 feet distant right on the aforesaid October 10, 1933 State Highway Layout Line; thence northeasterly along said October 10, 1933 State Highway Layout Line to a point by a bearing N 64°57’24” E and 239.91 feet distant on the aforesaid Proposed State Layout Line (Layout No. 7964); thence along the Proposed State Layout Line (Layout No. 7964) to a point by a bearing N 60°49’47” E and 120.62 feet distant; thence northwesterly by land now or formerly of the Commonwealth of Massachusetts to a point by a bearing N 45°40’50” W and 46.30 feet distant; thence to a point by a bearing S 64°57’24” W and 294.78 feet distant; thence by a bearing S 18°14’15” W and 71.65 feet distant to the point of beginning; containing about 16,660 square feet.
Parcel 9-TE-6 An easement is hereby taken in the parcel of land now or formerly owned by Town of Concord (Conservation), adjoining the northerly location line of the 1966 State Highway Layout (Layout No. 5637) of the Concord Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 9-TE-6 consisting of the right to enter upon said land at any time during the effective period of said easement to accomplish the necessary work within said parcel, including constructing slopes of excavation and embankment and to perform any other necessary incidental construction and bounded as follows: beginning at a point offset to the state baseline at station 20+64.48 and 56.21 feet distant right on the aforesaid 1966 State Highway Layout Line (Layout No. 5637); thence northeasterly along said 1966 State Highway Layout Line to a point by a bearing N 68°55’45” E and 89.69 feet distant to the October 10, 1933 State Layout Line (Layout No. 3049); thence to a point by a bearing N 18°14’15” E and 26.34 feet distant; thence to a point by a bearing S 58°13’00” W and 108.27 feet distant to the point of beginning; containing about 916 square feet. Said easement is temporary in nature and is to be in effect only for a period of five years from the date of recording the Order of Taking for this parcel.
Section 3: The Department of Highways and the Town of Lincoln are hereby authorized to divert the use of certain portion of parcels of land in Lincoln. These portions of parcels are owned by the Town of Lincoln and are to be diverted from their present use for conservation purposes to a highway use not withstanding any conservation restriction. As to parcel 7-TE-42, 7-TE-47 and 7-TE-48 the diversion of use will be temporary.
Section 4: Said parcels are shown on a plan entitled The Commonwealth of Massachusetts Plan of Land in the Town of Lincoln Middlesex County Article 97 Property. This plan shall be kept on file with the chief engineer of the Massachusetts Department of Transportation - Highway Division. The descriptions of the parcels referred to in Section 3 are as follows:

An easement is hereby taken in the parcel of land now or formerly owned by Town of Lincoln, adjoining the northerly location line of the January 17, 1933 State Highway Layout (Layout No. 2970) of the Cambridge Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 7-TE-42 for the purposes of the right to enter upon said land at any time during the effective period of said easement to accomplish the necessary work within said parcel, including constructing slopes of excavation and embankment and to perform any other necessary incidental construction and bounded as follows: beginning at a point offset to the state baseline at station 119+99.50 and 50.00 feet distant right on the aforesaid January 17, 1933 State Highway Layout Line; thence southeasterly along said January 17, 1933 State Highway Layout Line by a bearing S 58°58’43” E and 204.35 feet distant; thence to a point by bearing N 31°01’17” E and 23.34 feet distant; thence to a point by bearing N 58°58’43” W and 208.18 feet distant; thence southwesterly by land now or formerly of Walter J. Parcel 7-D-1 An easement is hereby taken in the parcel of land now or formerly owned by the Town of Lincoln, adjoining the northerly location line of the January 17, 1933 State Highway Layout (Layout No. 2970) of the Cambridge Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 7-D-1 for the purpose of constructing a drainage treatment swale and performing other incidental work in connection therewith and consisting of the right to enter upon said land at any time to construct thereon slopes of excavation and embankment and to maintain the slopes and bounded as follows: beginning at a point offset to the state baseline at station 117+95.15 and 50.00 feet distant right on the aforesaid January 17, 1933 State Highway Layout Line; thence southeasterly along aforesaid January 17, 1933 State Highway Layout Line to a point by a bearing S 58°58’43” E and 645.00 feet distant; thence to a point by bearing N 31°01’17” E and 73.00 feet distant; thence to a point by bearing N 58°58’43” W and 645.00 feet distant; thence by bearing S 31°01’17” W and 73.00 feet distant to the point of beginning; containing about 47,085 square feet.
Parcel 7-TE-47. An easement is hereby taken in the parcel of land now or formerly owned by Town of Lincoln, adjoining the northerly location line of the January 17, 1933 State Highway Layout (Layout No. 2970) of the Cambridge Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 7-TE-47, consisting of the right to enter upon said land at any time during the effective period of said easement to accomplish the necessary work within said parcel, including constructing slopes of excavation and embankment and to perform any other necessary incidental construction and bounded as follows: beginning at a point offset to the state baseline at station 111+50.14 and 50.00 feet distant right on the aforesaid January 17, 1933 State Highway Layout Line; thence southeasterly along aforesaid January 17, 1933 State Highway Layout Line by a bearing S 58°58’43” E and 309.96 feet distant; thence along aforesaid January 17, 1933 State Highway Layout Line by a curve to the right of 6,629.92 feet radius and 31.00 feet distant; thence to a point by a bearing N 31°01’17” E and 12.86 feet distant; thence to a point by bearing N 59°15’20” W and 340.95 feet distant; thence by bearing S 31°01’17” W and 11.13 feet distant to the point of beginning; containing about 4,078 square feet. Parcel 7-D-2 An easement is hereby taken in the parcel of land now or formerly owned by the Town of Lincoln, adjoining the northerly location line of the January 17, 1933 State Highway Layout (Layout No. 2970) of the Cambridge Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 7-D-2 for the purpose of constructing a drainage outlet and performing other incidental work in connection therewith and consisting of the right to enter upon said land at any time to construct thereon slopes of excavation and embankment and to maintain the drainage outlet and bounded as follows: beginning at a point offset to the state baseline at station 108+09.40 and 50.00 feet distant right on the aforesaid January 17, 1933 State Highway Layout Line; thence along aforesaid January 17, 1933 State Highway Layout Line by a curve to the right of 6,629.92 feet radius and 29.84 feet distant; thence to a point by bearing N 31°01’17” E and 25.04 feet distant; thence to a point by bearing N 58°58’43” W and 29.84 feet distant; thence by bearing S 31°01’17” W and 24.83 feet distant to the point of beginning; containing about 744 square feet.
Parcel 7-TE-48. An easement is hereby taken in the parcel of land now or formerly owned by Town of Lincoln, adjoining the northerly location line of the January 17, 1933 State Highway Layout (Layout No. 2970) of the Cambridge Turnpike (Route 2) and shown on the plan hereinafter referred to as Parcel 7-TE-48, consisting of the right to enter upon said land at any time during the effective period of said easement to accomplish the necessary work within said parcel, including constructing slopes of excavation and embankment and to perform any other necessary incidental construction and bounded as follows: beginning at a point offset to the state baseline at station 107+79.79 and 50.00 feet distant right on the aforesaid January 17, 1933 State Highway Layout Line; thence along aforesaid January 17, 1933 State Highway Layout Line to a point by a curve to the right of 6,629.92 feet radius and 349.29 feet distant; thence northerly along land now or formerly owned by Town of Lincoln to a point by a bearing N 05°17’00” E and 12.48 feet distant; thence to a point by bearing N 55°47’27” W and 192.46 feet distant; thence to a point by bearing N 57°42’32” W and 151.48 feet distant; thence by bearing S 31°01’17” W and 12.90 feet distant to the point of beginning; containing about 4,096 square feet. Section 5: The Department of Highways is hereby authorized to divert the use of certain portions of parcels of land in Concord. These portions of parcels are owned by the Commonwealth of Massachusetts and are to be diverted from their present use to a conservation use. The Department of Highways is hereby authorized to transfer the ownership of said parcels to the Town of Concord at a later date.
Section 6: Said parcels are shown on a plan entitled The Commonwealth of Massachusetts Plan of Land in the Town of Concord Middlesex County Proposed Conservation Land. Section 7: The Department of Highways is hereby authorized to divert the use of certain portions of parcels of land in Lincoln. These portions of parcels are owned by the Commonwealth of Massachusetts and are to be diverted from their present use to a conservation use. The Department of Highways is hereby authorized to transfer the ownership of said parcels to the Town of Lincoln at a later date.
