An Act authorizing the warrantless arrest for reckless or negligent vehicular homicide and reckless or negligent operation.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  This act may be cited as the Robert L. Martinelli Act.

SECTION 2. Section 21 of chapter 90 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word "person", in line 34, the following words:- , or whoever operates a motor vehicle recklessly or negligently so that the lives or safety of the public might be endangered in violation of paragraph (a) of subdivision (2) of section 24 and by such operation causes another person bodily injury which creates a substantial risk of death or which involves either total disability or the loss or substantial impairment of some bodily function, or whoever commits motor vehicle homicide in violation of subsection (a) or (b) of section 24G."
