In the Year Two Thousand Eleven

An Act relative to promoting local housing initiatives for economically diverse households.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 40A of the General Laws is hereby amended by adding the following section:-
Section 3A. All cities and towns shall, in their zoning ordinances and by-laws, provide opportunities for the creation of at least their municipality’s fair share of housing for households of median income, with due regard for regional housing needs as established by the regional planning agency and/or the Department of Housing and Community Development. This shall not preclude the establishment of zoning districts where only low-density development is permitted in order to protect natural and cultural resources, provided that the city or town has made adequate accommodation for a range of housing types and income levels in other zoning districts.
