An Act relative to Chapter 30B.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 1 of chapter 30B, as appearing in the 2008 Official Edition, is hereby amended by striking out subsection (5) of paragraph (b) in its entirety and inserting in place thereof the following:

(5) a contract for the purchase of materials, under specifications of the Massachusetts department of transportation highway division, and at prices established by the division, pursuant to advertising and bidding for such purpose, in connection with work to be performed under the provisions of chapter eighty-one or chapter ninety;

SECTION 2. Section 2 of Chapter 30B of the General Laws, as most recently amended by Chapter 188 of the Acts of 2010, is hereby amended in the definition of “Bid” by inserting at the end thereof the following:-

Electronic bids are only permitted if the governmental body has the capability to maintain the confidentiality of the bids until the bid opening time and the proposals until the evaluation process is complete.

SECTION 3.  Section 2 of Chapter 30B of the General Laws, as so appearing, is hereby amended, in the definition of “Proposal” by inserting at the end thereof the following:-

Electronic  proposals are only permitted if the governmental body has the capability to maintain the confidentiality of the bids until the bid opening time and the proposals until the evaluation process is complete.

SECTION 4. Section 2 of Chapter 30B of the General Laws, as so appearing, is hereby amended by striking the words:-  “and until the governmental body determines from which sellers it will buy based on the pricing obtained during the process.”
