An Act relative to personal injury protection.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Section 1.  Chapter 90 of the General Laws is hereby amended in section 34M by adding the following language to the end of paragraph 4:

After a bill has been presented to an insurer for payment under this section and the insurer has denied payment of that bill, if an insured or healthcare provider files suit, no insurer shall later be allowed to tender full payment of that bill without also paying the insured’s reasonable costs and attorney’s fees incurred up to the time said payment is made.
