An Act relative to the conditions of probation.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1.  Section 87A of Chapter 276, of the General Laws  appearing in the 2008 Official Edition, is hereby amended by adding the following section,  Section 87B   “Specified rehabilitation programs”

Section2. " Every person placed on supervised probation and into a specified rehabilitation program(s) shall attend on a schedule that aims to both rehabilitate and reintegrate the probationer.  Specified rehabilitation programs shall not run simultaneously nor concurrently." 

Section3. “In the event a court includes more than one specified rehabilitative program, the sentencing judge shall promptly write an opinion explaining the reasons for the issuance of each specified rehabilitative program.”

Section 4. Section 98 of said Chapter 276, as so appearing, is hereby amended by inserting after the words:- “the evaluation of the probation service in each court of the commonwealth”, in line 19, the following words:- " which shall include an evaluation of a probation officer’s ability to insure a probationer meets the conditions of probation.”

Section 5. Section 101 of said Chapter 276, as so appearing, is hereby amended by inserting after the words:- “with his suggestions or recommendations.”, in line 5, the following words:- “The report shall include employment and educational attainment statistics for all probationers who complete a probation sentence during the year.”
