An Act relative to the classification of synthetic cannabiniods as Class D controlled substances.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of chapter 94C of chapter 149 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the definition of “State”, the following definition:—
“Synthetic cannabinoid”, shall mean any of the following chemical compounds: (a) cp 47.497 and homologues: 2-[(1r,3s)-3-hydroxycyclohexyl] -5-(2-methyloctan-2-yl)phenol); (b) hu-210: [(6ar, 10ar)-9-(hydroxymethyl)-6,6-dimethyl-3- (2-methy loctan-2-yl)-6a,7,10, 10a-tetrahydrobenzo[c] chromen-1-ol)]; (c) hu-211: (dexanabinol, (6as, 10as)-9-(hydroxymethyl) -6,6-dimethyl-3-(2-methyloctan-2-yl)-6a,7,10, 10a-tetrahydrobenzo[c] chromen-1-ol); (d) jwh-o18: 1-pentyl-3-(1-naphthoyl)indole; (e) jwh-o73: 1-butyl-3-(1-naphthoyl)indole and (f) any compound, manufacture, salt, derivative, mixture or preparation of any such chemical compounds.
SECTION 2. Section 31 of chapter 94C, as so appearing, is hereby amended in paragraph (b) of the list of class D substances by inserting after the words “(4) 1-Nitrosoxy-Methyl-Propane” the following:—(5) Synthetic cannabiniods
SECTION 3. Subsection (a) of section 32E of chapter 94C, as so appearing, is hereby amended by inserting after the word “marihuana”, wherever it appears in the first, fourth, fifth and sixth lines, the following:—or a synthetic cannabiniod
SECTION 4. Section 32L of chapter 94C, as so appearing, is hereby amended by inserting after the word “marihuana”, wherever it appears in lines 2, 4, 22, 23, 29 and 33, the following:— or a synthetic cannabiniod
SECTION 5. Sect ion 32 L of chapter 94C, as so appearing is hereby further amended by inserting after the word “marihuana”, wherever it appears in lines 34, 40, 42, 43, 45 and 47, the following:—, a synthetic cannabiniod
