SECTION 1. The Division of Occupational Safety shall hold a public hearing in the event that the Environmental Protection Agency recognizes a lead test kit that is capable of both a positive and negative screen under 40 CFR 745.88. The purpose of the hearing is to determine whether the division shall continue to recognize and permit all test kits approved by the EPA for use prior to September 1, 2010.
SECTION 2. If the Division of Occupational Safety determines that continued recognition of all such test kits is protective of public health, cost-effective and consistent the division’s objectives under 454 CMR 22.02, the division shall promulgate regulations within (90) days revising the definition of “Recognized Test Kits” as defined at 454 CMR 22.02 to all the use of all such test kits.
