An Act relative to prohibiting the distribution, possession and use of all tobacco products..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Chapter 270, as appearing in the 2008 Official Edition, is hereby amended by striking Section 6 in its entirety, and inserting in place thereof the following new section:-

Section 6. Distributing, possessing and/or using any cigarette, chewing tobacco, snuff or any tobacco in any of its forms by a person is prohibited. Any offenders shall be punished by a fine of no less then $150 for the first offense, not less than $200 for a second offense and not less than $300 for any third offense or subsequent offense or by imprisonment in a house of corrections for not more than 6 months.

SECTION 2. Sections 6A and 21 of Chapter 270, as so appearing, is hereby repealed.

SECTION 3. Section 22 of Chapter 270, as appearing in the 2008 Official Edition, is hereby repealed.
