An Act to ensure Massachusetts elderly citizens to be notified of health programs available to them..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any provision of law to the contrary, the executive office of health and human services shall direct MassHealth to provide each beneficiary over the age of 65 with an annual notice of voluntary programs including Program of All Inclusive Care for the Elderly (PACE) plans, Senior Care Options (SCO) plans, Frail Elder Home and Community Based Waiver Program or any other voluntary elected benefit to which they are entitled to supplement or replace their MassHealth benefits. Such notice shall include a method for the beneficiary to indicate interest in for receiving additional information for any programs identified as of interest to them. The same notice should be supplied to a beneficiary every time they are subject to a redetermination of eligibility.
SECTION 2. The executive office of health and human services shall establish rules and regulations upon the passage of this section on or before June 30, 2011.
