An Act to amend section 142O of chapter 111 to phase-out stage II vapor recovery systems.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Insert the following subsections in section 1420 of Chapter 111:
(f) a motor vehicle fuel dispensing facility shall be exempt from the department’s Stage II system requirements if it begins operation after January 1, 2011.
(g) a motor vehicle fuel dispensing facility shall be exempt from the department’s Stage II system requirements if, upon department verification and approval, excavation of one or more underground gasoline storage tanks is required in order to install or repair a below-ground component of the Stage II vapor collection and control system or the facility replaces fifty ( 50) percent or more of its gasoline dispensers after the effective date of this subsection.
(h) the department shall not require that Stage II vapor collection and control systems be utilized in a motor vehicle fuel dispensing facility after January 1, 2012.
(i) within one year of January 1, 2012 or of becoming exempt from Stage II system requirements, whichever is earlier, a motor vehicle fuel dispensing facility must decommission its Stage II system in accordance with department requirements.
