An Act Relative to the Licensure of Landscape Architects.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1 Section 99 of Chapter 112 of the General Laws, is hereby amended by inserting after the first sentence of the first paragraph the sentence “No person shall practice or offer to practice landscape architecture in the commonwealth, unless such person shall have secured from the board a certificate of registration as a landscape architect.”

SECTION 2 Said section 99, is hereby further amended by inserting after the first paragraph the following paragraphs: The following persons and activities are exempted from the provisions of this chapter: Any architect registered under the provisions of chapter 112; and any professional engineer registered under section 45 of chapter 13. Nothing in this chapter shall  prohibit a vendor of goods and services, including but not limited to irrigation designers, general or landscape contractors, nursery staff, gardeners, landscape gardeners, landscape preservationists, landscape historians, and masons from providing drawings or graphic diagrams necessary for the proper layout of their goods or materials, or shall prevent a landscape designer who has been certified through appropriate industry programs from engaging in, for a fee, the design of outdoor spaces utilizing plant materials and incidental grade alterations, soils, soil amendments, paving, and/or building materials or arranging for installation of the same. Nothing in this chapter shall be construed in any manner to prohibit any person from making plans, drawings, or specifications for the personal use and enjoyment of any property owned by them. Notwithstanding the provisions of this section, no person exempted under this section or engaged in activities exempted under this section shall use the title "landscape architect" unless such person complies with the provisions of this chapter.

SECTION 3 Section 101 of Chapter 112 of the General Laws, is hereby amended in clause (a) by removing the following words “is at least twenty-three years of age” and changing the word ‘he’ to ‘he/she.’

SECTION 4 Section 101 of Chapter 112 of the General Laws, is hereby amended by striking out, in lines 5-6, the words “he is a citizen of the United States or has legally declared his intention of so becoming”
