An Act to update minimum creditable coverage.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 176Q, as recently amended by Chapter 288 of the Acts of 2010, is hereby amended by striking subsection (s) of section 3 and inserting in place thereof the following:

(s) to define and set by regulation minimum requirements for health plans meeting the requirement of "creditable coverage'' as used in section 1 of chapter 111M and update any dollar thresholds annually consistent with Internal Revenue Service guidelines for Health Savings Accounts; provided, however, that notwithstanding subsection (d) of section 2, no changes to the regulations defining minimum creditable coverage shall take effect until 90 days after the connector gives notice of the changes to the joint committee on health care finance, the joint committee on public health, the senate and house of representatives committees on ways and means and the clerks of the senate and house of representatives.
