An Act relative to health insurance.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding any general or special law to the contrary, if the division of insurance determines that the percentage rate of compliance, as required to be reported under chapter 176O, section 21, subsection (b)(2)(x), relative to  the benefits mandated for health benefit plans under chapters 175, 176A, 176B and 176G, is in the aggregate less than 100%, then on or before October 1, the division shall issue regulations to require carriers to offer health benefit plans in the commonwealth that include all of the benefits mandated for health benefit plans under chapters 175, 176A, 176B and 176G, but that allow for the purchasers of health benefit plans to opt out of purchasing coverage containing certain individual mandated benefits which are not reported to be included in 100% of the plans offered by the carriers’ self-insured customers.

SECTION 2.  Section 188 of chapter 149 of the General Laws, as appearing in the 2008 Official Edition,  is hereby amended by striking out, in line 18, the words "11 or more full-time equivalent" and inserting in place thereof the following:—

"50 or more full-time"
