In the Year Two Thousand Eleven

An Act relative to capping pensions at 400%.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Subdivision (2) of section 5 of chapter 32 of the General Laws, as most recently amended by chapters 21and 25 of the Acts of 2009, is hereby further amended by inserting after paragraph (e) the following new paragraph:
(f) In any given year, no retirement allowance, as provided for by this chapter, shall exceed 400 per cent of the average retirement allowance in the commonwealth. The board shall determine the average retirement allowance in the commonwealth as of January 1 of each year.”.
