In the Year Two Thousand Eleven

An Act relative to global positioning system technology and public employees.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the Commonwealth and its political subdivisions may not employ the use of Global Position System technology, or other similar technology, to monitor or track employees of the Commonwealth or its political subdivisions, unless the implementation and terms of use of such technology is mutually agreed to in a collective bargaining agreement.  In the absence of a collective bargaining agreement, the implementation and use of such technology shall be subject to the provisions M.G.L. chapter 7 sections 52-56.
