An Act establishing a seized animal fund.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 47 of chapter 94C of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after paragraph (9) of subsection (a) the following paragraph:-

(10) All animals that are used, or intended for use, to facilitate any violation of this chapter.  Any animal forfeited pursuant to this chapter shall be transferred to a local animal shelter.

SECTION 2. Section 47 of chapter 94C is further amended by inserting, after the word “purposes” in lines 134-135, the following:- and expend no less than 1% to assist animals seized by the commonwealth under this chapter with said funds to be deposited into the Seized Animal Fund. 

SECTION 3. Section 2 of chapter 29 of the General Laws, is hereby amended by inserting after Section 2BBB the following section:-

Section 2CCC. There shall be established and set on the books of the commonwealth a separate fund to be known as the Seized Animals Fund. There shall be credited to such fund 1% of revenues generated from section 47 of chapter 94C. Revenues credited to this fund will be used to aid animals that are seized pursuant to chapter 94C.  The funds shall be used for the transport of seized animals to a local animal shelter, the cost associated with the care, evaluation and adoption of the animal, the spaying and neutering of dogs and cats and any costs associated with rehabilitating the animal if it was used in fighting for sport.
