An act relative to the right to record with single consent for the purpose of accurate record keeping and/or self protection from potentially fraudulent or physically harmful encounters.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Paragraph 1 of subsection D of section 99 of chapter 272 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following clause:-
(g) for a communication service provider or for a person providing technical assistance at the request of the communication service provider if the interception or use either relates to the operation, maintenance and testing of that service, the protection of the rights or property of the provider or the protection of users of that service from fraudulent, abusive or unlawful use of that service; or, records the fact that a wire or electronic communication was initiated or completed in order to protect the provider, another provider furnishing service toward the completion of the communication or a user of that service from fraudulent, unlawful or abusive use of that service.
