An Act relative to the sale of second-hand motor vehicles.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, any person who sells more than three second hand motor vehicles during a calendar year must obtain a class 2 dealers’ license pursuant to Section 58 of Chapter 140. Municipalities are hereby authorized to remove at the owner’s expense not to exceed $100 dollars any second hand vehicle offered for sale to the public by an owner who has previously sold three vehicles during the calendar year and has not obtained a class 2 license. Any licensed class 2 dealer offering for sale vehicles at unauthorized locations may be subject to removal of the vehicle and a fine of $100 per vehicle by the municipality.
