An Act regarding tidal flow projects.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 5 of Chapter 131A of the General Laws is hereby amended by adding the following subsection:

(f) The restoration of a salt marsh by the commonwealth or a municipality accomplished by the removal of impediments to tidal flow may be exempt, subject to approval by the director, from the permit approval requirements of this section, provided that the marsh to be restored so the new opening for tidal flow has an effective cross section in square feet of one hundred fifty percent of the number of acres of salt marsh to be restored; provided further that notice which includes a description of said project describing its compliance with this sentence shall be filed with the department and the municipal conservation commission at least thirty days prior to the start of site work on the project.
