An Act to provide clear expiration date and method of proper disposal methods of medication.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 20 of chapter 94C of the general laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word “required”, in line 11, the following words:-  the expiration date, instructions for proper disposal.

SECTION 2.  Section 21 of said chapter 94C, as so appearing, is hereby amended by inserting after the word “container”, in line 10, the following words:- ; provided, that such label shall also include the expiration date of the substance and instructions for its proper disposal.

SECTION 3.  Section 22 of said chapter 94C, as so appearing, is hereby amended by inserting after the word “statements”, in line 15, the following words:- ; provided, that such label shall also include the expiration date of the substance and instructions for its proper disposal.

SECTION 4.  Chapter 94C of the general laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following two sections:-

Section 49.  All manufacturers of drugs sold in the commonwealth shall provide for labeling of such drugs that states the drug’s expiration date and instructions for its proper disposal.

Section 50. (a) An ultimate user who has lawfully obtained a drug through a written prescription in accordance with this chapter may, without being registered, deliver the prescription drug to a pharmacy for the purpose of disposal of the controlled substance.

(b) A pharmacy shall provide a receptacle for disposal of prescription drugs pursuant to this section. 

SECTION 5.  The department of public health shall promulgate rules and regulations to implement the provisions of this act.
