By striking out all after the enacting clause and inserting in place thereof the following:–
 

Mr. Dempsey of Haverhill moves that the House concur with the Senate in its amendment with a further amendment by striking out all after the enacting clause and inserting in place thereof the following:-

To provide for supplementing certain items in the general appropriation act and other appropriation acts for fiscal year 2011, the sums set forth in section 2 are hereby appropriated from the General Fund unless specifically designated otherwise in this act or in those appropriation acts, for the several purposes and subject to the conditions specified in this act or in those appropriation acts, and subject to the laws regulating the disbursement of public funds for the fiscal year ending June 30, 2011.  These sums shall be in addition to any amounts previously appropriated and made available for the purposes of those items.

SECTION 3. Section 2 of chapter 131 of the acts of 2010 is hereby amended by striking out item 0610-2000 and inserting in place thereof the following item:-

0610-2000For payments made to veterans pursuant to section 16 of chapter 130 of the acts of 2005; provided, that the office of the state treasurer shall not expend more than $205,000 for costs incurred in the administration of these payments; and provided further, that the treasurer shall notify the house and senate committees on ways and means upon the expenditure of the funds appropriated herein              $3,155,604

SECTION 4.  Item 1232-0100 of said section 2 of said chapter 131 is hereby amended by adding the following words:-  ; and provided further, that any unexpended funds in this item shall not revert and shall be made available for the purposes of this item until June 30, 2012.

SECTION 5. Item 1599-1027 of said section 2 of said chapter 131 is hereby amended by adding the following words:- ; provided, that any unexpended funding made available under this item shall not revert and shall be available for expenditure until June 30, 2012.

SECTION 6.  To the extent that any provision of chapter 25 of the acts of 2009 conflicts with a term of the Master Labor Integration Agreement, in this section called the agreement, executed by the Massachusetts Department of Transportation on or about December 29, 2010 or any agreement between the department and labor organizations representing employees transferred to the department executed between November 1, 2009 and the execution of the agreement, then the terms of the agreement or such other agreement shall prevail over such provision of said chapter 25. Notwithstanding any general or special law to the contrary, the department may recognize and negotiate with the exclusive bargaining unit representative identified in the agreement pursuant to chapter 150E of the General Laws for the units established in the agreement. Nothing in this section shall amend, modify or render ineffective any other applicable general law.             

SECTION 7. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $20,393,370 from item 4000-0430 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 8. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $40,885,233 from item 4000-0600 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 9. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $27,349,282 from item 4000-0700 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 10. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $4,201,638 from item 4000-0870 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 11. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $4,984,165 from item 4000-0880 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 12. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $609,312 from item 4000-0895 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 13. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $723,143 from item 4000-1400 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.

SECTION 14. Notwithstanding any general or special law to the contrary, the comptroller shall immediately transfer not more than $69,385,110 from item 4000-1405 of section 2 of chapter 131 of the acts of 2011 to item 4000-0500 of said section 2 of said chapter 131.
