AN ACT RELATIVE TO THE TOWN OF BURLINGTON REPRESENTATIVE TOWN MEETING FORM OF GOVERNMENT.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 1 of chapter 686 of the acts of 1970 is hereby amended by striking out the words “one hundred eight” and inserting in place thereof the following figure:-126 .

SECTION 2.  The first paragraph of section 4 of said chapter 686 is hereby amended by striking out the first 5 sentences and inserting in place thereof the following sentences:-

At the annual town election of 2012, there shall be a total of 18 town meeting members elected from the newly created 7th precinct.  The 6 candidates in the precinct who receive the highest number of votes shall be declared elected to a 3-year term. The 6 candidates in the precinct who receive the next highest number of votes shall be declared elected to a 2-year term.  The remaining 6 candidates elected in the precinct shall be declared elected to a 1-year term. The remainder of the unexpired term of any vacancy created by the removal of a town meeting member due to a revision of precincts shall appear on the same ballot as the election of the 18 town meeting members in said new 7th precinct.  Thereafter, in all precincts, candidates shall be elected for 3 years to fill expiring terms and to fill the unexpired term of any vacancy.

SECTION 3.  Said section 4 of said chapter 686 is hereby further amended by striking out the second paragraph, as amended by section 7 of chapter 160 of the acts of 1993.

SECTION 4.  Said section 4 of said chapter 686 is hereby further amended by striking out the fourth paragraph, as amended by section 3 of chapter 509 of the acts of 2002.

SECTION 5. Subsection (a) of section 12 of said chapter 686 is hereby amended by striking out the third and fourth sentences and inserting in place thereof the following 2 sentences:-  Special meetings may be held on any day other than a legal holiday on the call of the board of selectmen, moderator, or 10 or more members.  Notwithstanding section 10 of chapter 39 of the General Laws, the notice for said special meeting shall be posted on the town bulletin board and delivered to the place of residence of each member and that of the moderator no less than 7 days prior to the date of such special meeting.

SECTION 6.  This act shall take effect upon its passage.
